These Terms of Service (“Terms”) govern your access to and use of ReconHawk (the “Service”), a security monitoring product offered by Vukstone, LLC (“Vukstone,” “we,” “us”). By creating an account or using the Service, you agree to these Terms.
1. Eligibility & account
You must be at least 18 years old and have the authority to bind yourself or the organization you represent. You're responsible for maintaining the confidentiality of your credentials and for all activity that happens under your account. Notify us promptly at security@reconhawk.com if you suspect unauthorized access.
2. Subscription & billing
Paid plans renew automatically at the end of each billing period (monthly or annual, depending on the plan you chose) until you cancel. You can cancel anytime from your account settings; cancellation takes effect at the end of the current billing period. Unless required by applicable law, fees already paid are non-refundable.
Charges are processed by Vukstone, LLC and appear as “RECONHAWK” on your card statement. We may change pricing for future billing periods on at least 30 days' notice via email.
3. Acceptable use
You agree to use the Service only for lawful purposes. You will not:
- Submit any domain or asset for monitoring or scanning that you do not own or do not have explicit, documented authorization to test.
- Use the Service to launch denial-of-service attacks, attempt to bypass security controls of systems you don't own, or facilitate unauthorized access to any third-party system.
- Reverse engineer, decompile, scrape, or otherwise attempt to derive the source code of the Service except where applicable law expressly permits.
- Resell, redistribute, or expose the Service to third parties outside your organization without a written agreement with us.
- Upload or transmit viruses, malware, or any other harmful code, or attempt to interfere with the integrity or performance of the Service.
We reserve the right to suspend or terminate accounts that violate this section, with or without notice depending on the severity.
4. Security testing — important disclaimer
ReconHawk performs automated security checks (DNS, email authentication, configuration auditing, vulnerability scanning, uptime monitoring, and similar). These checks are useful but inherently incomplete and cannot guarantee the discovery of every security weakness present in your systems. New vulnerabilities are published daily; attackers use techniques that automated scanners do not detect; and your systems may have weaknesses that fall outside the scope of what the Service tests.
You acknowledge that:
- The Service is provided as a monitoring and informational tool, not as a substitute for a comprehensive security program, qualified human review, or professional penetration testing.
- Vukstone makes no representation, warranty, or guarantee that the Service will identify all (or any specific) vulnerabilities, misconfigurations, intrusions, or risks affecting your systems.
- Any decisions you make based on output from the Service — including decisions not to take additional security action — are your own. Vukstone is not liable for losses arising from vulnerabilities or attacks the Service did not detect, did not report in time, or reported with incomplete information.
5. No warranty
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM HARMFUL COMPONENTS, OR THAT IT WILL DETECT ALL VULNERABILITIES OR THREATS.
6. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VUKSTONE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE — INCLUDING DAMAGES ARISING FROM A SECURITY INCIDENT, BREACH, OR VULNERABILITY THAT THE SERVICE DID NOT DETECT OR REPORT.
OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO VUKSTONE FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY (OR USD $100, WHICHEVER IS GREATER).
These limitations apply even if a remedy fails of its essential purpose, and they apply to the fullest extent permitted by law in your jurisdiction.
7. Indemnification
You agree to defend, indemnify, and hold harmless Vukstone, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any submission of a domain or system you did not have authorization to test.
8. Intellectual property
The Service, including all software, content, design, and documentation, is owned by Vukstone and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.
You retain ownership of any data you submit to or generate through the Service (“Customer Data”). You grant us a limited license to host, process, and display Customer Data solely to provide and improve the Service.
9. Termination
You may stop using the Service and cancel your account at any time. We may suspend or terminate your access if you breach these Terms or if we are required to do so by law. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination — including disclaimers, limitations of liability, and indemnification — will survive.
10. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll notify you via email or through the Service at least 14 days before they take effect. Continued use of the Service after changes take effect means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of the State of Vermont, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be brought exclusively in the state or federal courts located in Vermont, and you consent to personal jurisdiction in those courts.
